Els Leye and Ino Kehrer 105 Female Genital Mutilation as a Form of Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment: Intersections with the Migration Context elS leye anD ino kehrer* Abstract This paper seeks to explore how female genital mutilation (FGM) amounts to torture or other cruel, inhuman, and degrading treatment (CIDT) or punishment, with a specific focus on how the inter section with migration compounds torture and CIDT. The paper argues that the application of the torture framework is needed to prevent, protect, and provide access to justice for those affected by FGM. Some lessons learned from Europe regarding the implementation of the SRT’s recommenda tions will be shared, and additional recommendations will be provided. * Els Leye: PhD, International Centre for Reproductive Health—Ghent University/RHEA Centre of Expertise on Gender, Diversity and Intersectionality—Free University Brussels, Belgium, els.leye@ugent.be.
