and irreversible consequences of the breach of interim measures in cases involving the death
penalty, it is time for the Committee to adopt a clear, consistent and legally reasoned position
on this critical issue.

We therefore consider that, in the present case, such a critical issue should have been
included in a specific paragraph in the section of the Views on issues and proceedings, as
well as in the part on remedies. The Committee should have clearly spelled out the
consequences for the State of violating this particular obligation under the Optional Protocol.
