Investigating human rights
suggested that paper or Styrofoam cups also be purchased for the other
correctional institutions.
Proposal accepted
The Federal Ministry of Justice accepted this proposal and included it in the
project “Furnishings for specially secured inmate cells”. The Ministry promised
implementation by the spring of 2017.
Penal system - Health care
In this reporting period, the AOB has again received numerous complaints
about inadequate medical care. There were evidently continuing coordination
problems when services outside of the correctional institution had to be utilised:
appointments with specialists were not kept or examinations in hospitals were
not made.
One inmate at the Stein correctional institution complained that he was
suffering from an eye disease, which was getting much worse and required a
cataract operation. At the subsequent examination in January 2013, the eye
specialist recommended a follow-up appointment after six months. However,
he was not taken to an eye specialist until after a year.
Follow-up appointment
much too late
The Federal Ministry of Justice confirmed that the examination was not
conducted after six months, as recommended, but after one year. No
reasons were given for this. The AOB criticised the prison administration for
arranging such a late follow-up appointment for the inmate. The fact that the
recommended time for the examination appointment was not met constitutes
organisational negligence on the part of the Stein correctional institution.
No computer tomography performed
An inmate at the Mittersteig correctional institution complained that computer
tomography, recommended by the institution’s physician, was not performed.
This was to have been performed in the Vienna Barmherzige Brüder hospital.
The Federal Ministry of Justice stated that the “organisational restructuring” at
the hospital resulted in short-term modifications or cancellations of scheduled
examinations. In the opinion of the medical superintendent in the general
directorate for prisons and detention of the Federal Ministry of Justice, an
adequate level of medical care is guaranteed to inmates.
To avoid such incidents in the future, a promise was made to have a clear
discussion with the persons in charge at the Vienna Barmherzige Brüder
hospital.
The AOB understands that cancellations and brief postponements of
appointments by the hospital are not the responsibility of prison authorities.
However, it should be ensured that recommended medical examinations are
carried out. It is subject to criticism that no further action, such as a discussion
