Investigative proceedings within the federal administration 2016
The AOB’s investigative activities cover the entire public administration, i.e.
all authorities and departments whose duty it is to implement federal law.
The AOB carried out a total of 6,121 investigative proceedings in matters
involving federal administration. This is equivalent to an increase of around
13% compared to the previous year.
Investigative
proceedings regarding
internal security issues
are most frequent
As in the past three years, most of the investigative proceedings dealt with
the internal security sector. About a third of all proceedings (34.8%) are from
this area. What is noticeable is that the investigative proceedings in this area
have risen sharply compared to last year (2,130 cases as opposed to 1,496 in
2015). This development is attributable to the large number of complaints
dealing with asylum law. In the year under review, a substantial portion of the
complaints concerned the Federal Office for Immigration and Asylum, which
is responsible for asylum proceedings in the first instance, and the Federal
Administrative Court, which is responsible for appeals in asylum proceedings.
Every fourth complaint
deals with social affairs
The social affairs sector holds second place. Around a quarter of all complaints
resulting in an investigative proceeding dealt with social insurance law or
problems surrounding the labour market. The main reasons for complaints
were deficiencies in the area of the Public Employment Service Austria (AMS),
the assessment of entitlement to care and nursing allowances and problems
surrounding pension insurance law. The number of complaints regarding
persons with disabilities continues to be high.
Investigative
proceedings in the
judiciary have risen
sharply
There were 927 investigative proceedings initiated based on complaints
concerning the judiciary, which is equivalent to about 15% of all of the
investigative proceedings initiated. Compared to the previous year, the
number of investigative proceedings in this area rose by around 22%. The
concerns related to the duration of court proceedings and proceedings by
public prosecutors’ offices and the penal system.
