The letter sent by the UN Subcommittee on Prevention of Torture to the Government of Georgia on December 10, 2018 referred to Georgia's failure to meet its obligations under the Optional Protocol. In the correspondence, the Subcommittee emphasized the necessity of granting the National Preventive Mechanism unrestricted access to all relevant data, including medical documentation, registers and other documents. It is unfortunate that the State has not yet taken measures to eliminate this problem. The Public Defender calls on the Government and Parliament of Georgia to immediately ensure the fulfillment of obligations as defined in the Optional Protocol and to eliminate all the restrictions and obstacles encountered by the National Preventive Mechanism in terms of accessing special categories of personal data.
