The Committee concludes that, in the specific circumstances of the case, the complainant has failed to establish a foreseeable, real and personal risk of being tortured if he were to be returned to Turkey. The Committee welcomes the State party’s readiness to monitor the complainant’s situation following his return to Turkey and requests it to keep the Committee informed about said situation. 14. The Committee Against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment of Punishment, concludes that the State party’s decision to return the complainant to Turkey does not constitute a breach of article 3 of the Convention.
