Case No. 12/00509
Can a school expel students because of their
behaviour during their leisure time and outside
the school’s grounds? The Ombudsman investigated this issue when a higher preparatory
course student complained because he had
been expelled from both his day and boarding
school.
The student had smoked cannabis during a
night out on the town on a weekend, and this
was against the school’s house rules. However, there was no evidence that the student
had been visibly affected on his return to the
school or that his behaviour had in any other
way inconvenienced the school. For this reason, among others, the school had no authority to expel the student, said the Ombudsman.
The Ombudsman’s statement, which also
took a position on various other questions of
fundamental importance, can be read in full (in
Danish) on www.ombudsmanden.dk, Case No.
2013-24.
The Ombudsman has published 28 selected
statements and reports which are to be regarded as part of the 2013 Annual Report of
the Parliamentary Ombudsman because he
finds them to be of significant and fundamental importance. Before a statement or report is
made public, the Ombudsman decides which
personal information is to be removed from the
text.
