beings can in many cases be seen as committed with the
intent to inflict severe pain and suffering. The level of pain
and suffering inflicted on victims of trafficking can often
be compared to the level inflicted on victims of torture in
the context of police interrogation. Torture requires a specific purpose. Exploitation within the context of trafficking in human beings implies intimidation, punishment and
coercion, which are all purposes of torture. Furthermore,
discrimination as a purpose of torture can be linked to trafficking in human beings when the act of trafficking clearly
shows a discriminatory element.
Even if one of the requirements of torture such as the
powerlessness of the victim or the existence of a specific
purpose cannot be sufficiently proven, these acts of trafficking in human beings may amount to other forms of illtreatment. Depending on the facts of each individual case,
trafficking in human beings can amount to torture or to
other forms of ill-treatment.
