CCPR/C/113/D/2192/2012 Appendix Individual opinion of Committee member Dheerujlall Seetulsingh While I agree with the conclusions of the Committee on the non-respect of the Committee’s request for interim measures (see paras. 8.1-8.3), I do not consider that this should be equated with a violation of article 1 of the Optional Protocol to the Covenant. Rule 92 of the rules of procedure of the Committee, which enables the Committee to make a request for interim measures, should ideally have been included in the Optional Protocol. It is true that interim measures are necessary to protect the human rights of the author, but non-respect of the Committee’s request constitutes a breach of obligations and does not amount to a violation of the Optional Protocol. Consequently, I find that paragraph 11 is unnecessary. 13
