employees of the Office was established and the group was assigned within
ten days to prepare and submit to the Commissioner recommendations and an
appropriate action plan for the organization of the work aimed at performing
the NPM functions.
The working group has undertaken necessary
organizational actions pursuant to the Order and summarized the
recommendations received through appeals from various governmental bodies,
as well as international organizations, at the same time relevant best practices
have been explored and analyzed, an action plan has been prepared, the list of
the establishments, where arrested persons or persons whose liberty has been
otherwise restricted are held in the country, has been drawn up, as well as
practical activities have been initiated in relevant directions.
The main issue which the Commissioner is faced with and needs to be
solved within a short period of time in order to more effectively organize the
work of the NPM has been the duty to bring her mandate in conformity with
the requirements of the OPCAT and create a new specific structural unit in the
Office.
For this purpose the mandate of the Commissioner has been analyzed by
the Office in the context of the OPCAT and relevant recommendations have
been prepared with regard to prospective trends. Along with the above
mentioned, the composition and regulations of the new structural unit to be
established in the Office – Torture Prevention Affairs Department, additions to
the staff lists and budgets of the Office and regional centres, as well as the
relevant Order of the Commissioner have been drafted and sent to the relevant
bodies for approval. As well as some additions and amendments to the
Constitutional Law have been drafted and submitted to the Milli Majlis
(Parliament) of the Republic of Azerbaijan.
Until the budget of the above mentioned unit is approved, 5 employees of
the structural units within the current budget the Office were involved in the
NPM-related activities. Later, pursuant to the Commissioner’s Order of 9
January 2010 the Commissioner’s NPM Group was established. The Group
led by the Commissioner and comprised of the Subcommittee on Visits and
the Subcommittee on Preparation of Documents and Reports included 8
employees of the Office. Afterward, in order to ensure the expansion of the
