Report of the Eminent Jurists Panel on terrorism, counter-terrorism and human rights
policies. In the Hearings in the Southern Cone and elsewhere, which reflected on
learning from the past (see Chapter Two), witnesses frequently drew stark parallels between the ideology and techniques promoted in the past and contemporary
practices. The Panel was led to the conclusion that the militarisation of the counterterrorism strategy, within the framework of a distorted interpretation of the laws
of war, has served in the past to undermine the rule of law, and is doing so again
today. Terrorism, outside situations of genuine armed conflict, is best addressed by
a strong, well-resourced, and human rights compliant system of law enforcement
(see Chapter Six).
