Performance record 1 Performance record 1.1 Monitoring public administration Every sovereign administrative act carried out by the Federal Government falls under the remit of the AOB’s monitoring and control authority. This also applies for actions set by the Government as holder of private rights. This corresponds directly with the AOB’s obligation to pursue every permissible complaint and inform those affected of the result. The AOB is thus there to assist all citizens who feel that they have been unfairly treated by Austrian authorities. The AOB can also initiate ex-officio investigative proceedings if maladministration is suspected. It is furthermore authorised to call upon the Austrian Constitutional Court in order to appeal regulations issued by federal authorities. This means that the AOB received an average of 74 complaints each working day. The AOB initiated an official investigative proceeding in around half of all complaints (9,268). An additional 4,951 complaints were within the mandate of the AOB but no investigative proceedings were initiated due to a lack of sufficient evidence. In these cases, the AOB was able to offer support with information on the legal situation and general information. 4,273 of the submissions involved questions that were outside the AOB’s investigative mandate. In these cases, the AOB tries to help with information as well. 13
