The Committee is concerned, however, that according to these reports such violence is also taking place in other parts of the country. 9.8 Accordingly, the Committee finds that, taking into account all the factors in this particular case, substantial grounds exist for believing that the complainant will be in danger of torture if returned to the Democratic Republic of the Congo. 10. The Committee, acting under article 22 (7) of the Convention, concludes that the complainant’s removal to the Democratic Republic of the Congo by the State party would constitute a breach of article 3 of the Convention. 11. Pursuant to rule 112, paragraph 5, of its rules of procedure, the Committee wishes the State party to inform it, within 90 days from the date of the transmittal of this decision, of the steps it has taken in response to the present decision. 10
