This legislative gap gives rise to a number of problems, both in the uniform implementation of a policy for the operation of Care Homes and in their inspection by independent bodies. A person’s admission to a state or private Care Home is linked to his ability to decide freely and upon acquiring full information about his living conditions, as well as to his fundamental right to freedom and family and private life.
