MONITORING PLACES OF DETENTION : A PRACTICAL GUIDE FOR NGOS
99
Comments
The official registration of persons deprived of their liberty, regardless of the actual form –i.e., paper or electronic register– is an
essential element in guaranteeing transparency of the authorities and
protection of those detained.
The following must be recorded:
■
the identity of the person;
■
the reasons for the deprivation of liberty;
■
the time of arrest, the time when the arrested person was taken to
the place of detention, and the time when he/she first appeared
before a judicial or other authority;
■
the identity of those responsible for application of the relevant
laws;
■
precise information about the place where the person is detained
(quick location of all persons deprived of their liberty should be
possible).
There should also be a register in which any incidents are systematically recorded (use of force, disciplinary measures, ...)
Some reference points
■
Are entry and exit registers rigorously kept?
■
Are all incidents recorded in a register?
