ANNUAL SPECIAL REPORT 2017 55 right to appeal and challenge the decision, as well as the right to request lifting or replacement of the therapeutic measures themselves. L. 4509/2017 also covers regular monitoring of the maximum time of commitment, which so far had been mostly unmonitored and extremely long, according to the Authority’s findings. Article 16 defines the boundaries of extreme psychiatric care and security measures (such as protective isolation and physical restraint), with a direct reference to the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) guidelines, on the condition that all techniques for de-escalation of violent behavior have failed. Finally, article 19 designates the Greek Ombudsman as a monitoring authority for patients’ rights violation. Pursuant to the above, the NPM once more states its consistent position that ensuring quality treatment must take priority over penitentiary guard and will, in this context, monitor the implementation of the new legal framework.
