that, talcing into account all the factors and in the particular circumstances of this case,
substantial grounds exist for believing that the complainant will be in danger of treatment
contrary to artic1e 1 of the Convention if retumed to Guinea.

In ,the light of the above, the Committee against Torture, acting under artic1e 22,
paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading
Treatment or Punishment, con.c1udes that the complainants' removal tq Guinea by the State
party would constitute a breach of artic1e 3 of the Convention.

The CO:flli!littee is of the view that the State party has an obligation, in accordance
with artic1e 3 of the Convention, to refrain from forcibly retuming the complainant to
Guinea or to any other country where she runs a real risk of being expelled or retumed to
Guinea. Pursuant to ruie 118, paragraph 5, of its ruies of procedure, the Committee invites
the State party to inform it, within 90 days from the date of the transmittal of this de cis ion,
of the steps it has taken in accordance with the above observations.
