MINISTRY OF BUSINESS AND GROWTH No statements on cases concluded in 2015 have been published. D. MINISTRY OF FINANCE The following statements on cases concluded in 2015 have been published: 2015-21. Citizens’ right to use Public Digital Post and the receiving capacity of the public e-mail solution The Ombudsman took up a case on his own initiative with the Agency for Digitisation and the Ministry of Finance concerning, among other things, the capacity of Public Digital Post. The Ombudsman stated that according to section 8 of the Public Digital Post Act, citizens (including enterprises and other legal entities) are entitled to use Public Digital Post as their mail solution in communication with public authorities. In the Ombudsman’s perception, the capacity of the digital mail solution may be assumed to constitute a considerable obstacle or impediment to the right in section 8 of the Public Digital Post Act. The Ombudsman expressed the opinion that the difficulties he had pointed out must be presumed to affect the use of the digital mail solution to such an extent that the right pursuant to section 8 cannot be considered to be real. This problem should have been addressed when the digital mail solution was established. Consequently, the existing solution cannot be said to comply fully with the provision in section 8 of the Public Digital Post Act.
