CAT/C/41/D/323/2007 page 9 exempts the complainant from obtaining the consent of the alleged victims who were subsequently moved to Melilla to act on their behalf. In such circumstances, the Committee considers that the complainant lacks competence to act on behalf of the alleged victims in accordance with article 22, paragraph 1, of the Convention. 8.4 Having concluded that the complainant does not have locus standi, the Committee considers that there is no need to rule on the question of exhaustion of domestic remedies. 9. Accordingly, the Committee decides: (a) That the communication is inadmissible; (b) That this decision shall be communicated to the State party and to the complainant.
