On the basis of its findings, the Working Group makes recommendations to the
Government aimed at strengthening the control over the legality of detention at all stages of the
criminal justice process. The Working Group calls upon the Government to urgently address the
situation of detainees held under the old Criminal Procedure Code. It also recommends the
establishment of a specific, professionally staffed penitentiary system separate from the police.
Finally, the Working Group stresses the importance of strengthening prevention, law
enforcement and criminal justice in dealing with the maras specifically, and with crime in
general, instead of relaxing the rule of law and the protection against arbitrary detention.
